1. General Provisions

These terms and conditions govern your use of our website (exleasingcar.com). By using our website, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website. We may revise these terms and conditions from time-to-time. You will be notified by e-mail about updates. Revised terms and conditions will apply to the use of our website from the date of the publication of the revised terms and conditions on our website.

2. The parties and the agreement

These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website. Our company UAB "Gelgotos transportas" is Joint-Stock company, company code 300016057, which is based in Marijampolė. The address of the company are Gėlyno g. 9, LT-09200, Marijampolė, Lithuania; tel.: +370 343 70236, fax.: +370 343 99034. The company organizes auctions of vehicles operating in this website.

3. Licence to use website

Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all these intellectual property rights are reserved. To copy, distribute, publicly available material from this site without our written permission is strictly prohibited.

You must not use our website in any way that causes or may cause, damage to the website, or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

4. Restricted access

Access to certain areas of our website is restricted. We reserve the right to restrict access to other areas of our website, or indeed our whole website, at our discretion.

To access the auction section of the website, you must register. Registration is free of charge. To ensure reliability and security of our auctions, we ask to provide us with a copy of your passport and bussiness certificates (for companies) by e-mail or fax. Not until we have received these documents, you will not be able to login and submit your bids.

If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that that user ID and password is kept confidential, may not be transfered or sold to any other party.

We may disable your user ID and password in our sole discretion without notice or explanation.

5. Sale and purchase procedures

Auction conducted irregularly, a defined time. These auctions offer new or used vehicles and as far as possible, are described in detail. You can submit bid for one or several vehicles via our website. Bids can only be submited until end of the auction, bids received after will be rejected. Until end of the auction you can change or cancel your bids, after that all offers are final and bidding.

Exleasingcar acts as an intermediary between seller and buyer. The seller of the vehicle has the final desicion to accept the highest bid or not. Exleasingcar announces the seller about the highest offers immediately after end of the auction. In case you placed a highest bid and at the moment the seller agrees, a vehicle is allocated to you and you will receive the purchase order as confirmation, which must be signed and stamped and sent back to Exleasingcar by fax or email within 24 hours.

6. Payment

You are responsible for paying all costs related to using our services and the website, as well as all associated taxes. Purchased vehicle must be paid within 5 business days of the receipt of the purchase order. Ownership of the vehicle will be transferred to you only after full payment. You are responsible for paying all costs associated with the vehicle after its purchase.

7. Liability

We are only responsible for the correct representation of the information obtained, including any visual damage as described in damage report. The vehicle is sold in in its current state as known and accepted by the buyer and without of warranty. The buyer know the vehicle description, the defects and general condition and agrees with them. Major defects must be reported in writing within 48 hours of picking up the vehicle and before any repairs are made. Minor defects, whose repairing price is below 250 EUR, will not be examined.

8. Transportation

The vehicle within 30 days period from the date of purchase order must be taken from its location. We reserve the right to charge overdue 2 EUR, excluding VAT tax for each day of delay. The customer's request we can deliver the vehicle in a separate agreement.

All costs associated with vehicle transport, customs duties or other taxes paid by the buyer.

9. Breaches of these terms and conditions

Failure to meet these conditions, relating to the sale and purchase procedures, the payment or transfer, we reserve the right to cancel the sale of the vehicle and seek compensation, 10% of the purchase order amount, but not less than 250 EUR, excluding VAT.

If you breach these terms and conditions in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website and/or bringing court proceedings against you.

10. Law and jurisdiction

These terms and conditions will be governed by and construed in accordance with Lithuania law, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Lithuania.
